Cooling Mattress Toppers Sit Outside the Open Flame Rule, and Nobody Defines Cooling

Federal law names mattress toppers only to exclude them. That changes what a buyer can verify, and it puts the weight on the handful of numbers makers do publish.

We have not tested a topper and we have not slept on one. This article compares what federal flammability law says about the category, what the certification mark on the box is certifying, and the specifications two makers publish on their own pages, read October 1, 2026. Our selection rule: toppers currently sold by the company that makes them, with a public product page we opened, each checked against the CPSC recall database the same day.

That approach matters more here than usual, because the category sits in an odd legal position. A mattress is governed by two federal standards. A topper, which does the same job for the top two or three inches of a bed, is named in one of them only so it can be excluded.

Where a topper sits in federal law

The open flame standard defines a mattress at 16 CFR 1633.2(a), and paragraph (a)(2) lists what the term excludes. The second item is mattress toppers, described in the regulation as items with resilient filling, with or without ticking, intended to be used with or on top of a mattress. CPSC repeats the exclusion in its own business guidance. A topper does not have to pass the 30 minute burner test the mattress under it had to pass.

The older smoldering standard is more interesting, because it does not use the word topper at all. 16 CFR 1632.1(b) defines a mattress pad as a thin, flat mat or cushion, and ticking filled with resilient material for use on top of a mattress. The definition expressly includes convoluted foam pads that are totally enclosed in ticking, and expressly excludes convoluted foam pads that are not. CPSC summarizes the same line in plainer words: foam pads are specifically identified as being excluded from the scope of the standard.

Read together, those two provisions draw a line through the shelf. A ticking-enclosed product made to go on top of a mattress is a mattress pad, and it has to pass the cigarette test at 16 CFR 1632.3(b) with a char length of no more than 2 inches. A foam slab with a zip-off cover sold as a topper is outside the open flame rule by name, and depending on construction may sit outside the smoldering rule too.

The word on the package decides which federal rule, if any, the product had to satisfy.

What cooling means when nobody defines it

There is no federal definition of a cooling mattress topper, and neither flammability standard addresses temperature. The word is a marketing description, and the marketing is not uniform. Nectar sells a two-inch topper whose page credits gel-infused foam and a cover with cooling yarns; Tempur-Pedic sells a three-inch topper whose page describes the cover as cool to the touch rather than the core.

What a buyer can hold on to instead is construction, and makers do publish that. A cover described as cool to the touch is a property of the fabric; gel infused into a slab is a property of the slab. Neither is measured on a scale anyone publishes, and no certification mark on a topper carton attests to either. We treat the word cooling the way we treated the word true in our piece on what true HEPA means: a descriptor that travels further than its definition.

The claim worth examining is the one about the cover, because a buyer can act on it. Tempur-Pedic states that its topper cover is removable and machine washable and that the core must not be washed or dry cleaned, a care line as consequential as the ones on heated blankets. Nectar states that its toppers are certified by CertiPUR-US for content, emissions and durability.

What the certification on the box does and does not cover

CertiPUR-US is a voluntary certification program administered by the Alliance for Flexible Polyurethane Foam, Inc., a nonprofit incorporated in 2008, and the name and logo are registered certification marks of that body. It is an industry program, not a government one, and its own pages say so plainly. The published Technical Guidelines for Slabstock Foam, 2025 version 1, state that certification is specific to the foam cushioning material in products including mattress toppers, not to the finished product.

The guidelines set out what is tested. Foam samples taken at the manufacturing stage go to an approved independent laboratory for content and emissions analysis. The limits include formaldehyde below 0.015 milligrams per cubic meter and total VOC below 0.5. Lead is capped at 90 parts per million, several named flame retardants are prohibited, and physical property testing covers compression set and indentation force deflection.

What it does not cover is also stated. There is nothing about thermal performance in the guidelines, nothing about firmness as a consumer scale, and nothing about the cover. CertiPUR-US also notes that only registered companies may use the name, and that it cannot vouch for a brand absent from its directory. That is the structure we found in PFAS filter certification: a real test program with a limited scope.

What the makers actually publish

Two product pages read on October 1, 2026 show how thin the published specification is. Tempur-Pedic lists its topper at three inches of its own material, a removable washable cover, a stretch skirt for mattresses up to 13 inches deep, a 10 year warranty, an instruction that compressed products be opened within 30 days of receipt, and no returns. Nectar lists its firmer topper at two inches of gel memory foam with a 100 night trial and a one year warranty.

Neither page publishes a foam density in pounds per cubic foot, and neither publishes an indentation force deflection figure. We looked for both. That absence is the normal state of the category rather than an oversight by two brands, and it is why the only quantities in the table below are thickness, fit and warranty term.

Who should buy now and who should wait

Buy now if you have measured your mattress depth against the skirt the topper is built for, and the care instructions match how you intend to clean it. Both checks are answerable from the published page, and both decide whether a topper stays put and stays usable.

Wait if you are buying mainly for the word cooling, because nothing on the page is testable and no mark on the carton covers it. A topper is a surface layer, not a repair for a mattress that is already failing; our work on mattress pricing covers the replacement question.

The empty recall file does not mean the category has a clean record. CPSC records a recall when a firm agrees to one or the agency compels it, and a product type outside both mandatory standards generates fewer enforcement actions by construction.
